According to article 12 of the new European data protection regulation (GDPR) I am obliged to give information about what happens with possible visitor data on the pages of Fernweh-Koch.de.  Basically, I can keep it short at first, because everything detailed will come in the next sections.

What do I do with the visitor data? The answer: Nothing! I actively do not collect any personal data or forward them in any form, since this is neither intended nor in any way a business interest of mine.

In the past weeks before the GDPR finally came into force on May 25, 2018, I have made every effort to ensure that my blog complies with data protection regulations. For this purpose, the pages are transmitted encrypted via SSL script, IP addresses are anonymized and still not stored, social media plugins are replaced by images or conforming plugins and opt-out possibilities are offered within this declaration.

If you visit my blog, you simply have to expect that cookies will be used, otherwise these pages will not work as well. If you are so nice and leave me a comment with your clear name, you should be aware that every other visitor can see this name (the IPs are not stored, as I said).

So again: I have no bad intentions to handle any visitor data, let alone to process or forward them. Therefore I have used all possibilities I know of and which are realizable with my technical skills to protect the data of my visitors. Nevertheless in the following all details again. If you want to, you can read them, they are similar to the terms and conditions, everyone reads them.

1. Overview

The following notes provide a simple overview of what happens to your personal data when you visit fernweh-koch.de. Personal data is all data with which you can be personally identified.

For detailed information on the topic of data protection, please refer to our privacy policy listed below this text. The collection and processing of data is carried out by the operator of fernweh-koch.de, whose data you can find in the imprint, and possible partners listed below in the privacy policy. On the one hand, the collection is done by the information you actively provide, for example in the contact form, on the other hand, it is automated by our IT systems, which mainly collect technical information about the operating system or the browser. This collection takes place automatically when you visit fernweh-koch.de. The data is collected, among other things, for the error-free provision of the website or to analyze your user behavior in order to constantly optimize fernweh-koch.de.

At any time and free of charge, you can receive information about the origin, recipient and purpose of your personal data. In addition, you can request the correction, blocking or deletion of this data. If you have any comments or queries in this regard, you can contact us at any time at the address given in the imprint. Furthermore, you have the right to complain to the responsible supervisory authority.

As mentioned, some of your data may be collected by partners and analysis programs in order to statistically record and evaluate your surfing behavior. 2. General notes and mandatory information

2.1 Data protection

The operators of fernweh-koch.de take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the legal data protection regulations and this privacy policy.

If personal data (such as name, address or e-mail address) is collected on our pages, this is always done on a voluntary basis, as far as possible. This data will not be passed on to third parties without your express consent. We would like to point out that data transmission over the Internet (e.g. communication by e-mail) can have security gaps. A complete protection of data against access by third parties is not possible.

2.3 Revocation, information and complaint

You have the right to receive information about your personal data stored by us at any time. You also have the right to correction, blocking or, apart from the prescribed data storage for business purposes, deletion of your personal data.

In order that a blockage of data can be considered at any time, this data must be kept in a block file for control purposes. You can also request the deletion of the data, as long as there is no legal archiving obligation. If such an obligation exists, we will block your data upon request. You can make changes or withdraw your consent by notifying us accordingly with effect for the future.

2.4 SSL or TSL encryption

This site uses SSL or TSL encryption for security reasons and to protect the transmission of confidential content, such as the requests you send to us as site operator. You can recognize an encrypted connection by the fact that the address line of the browser changes from „http://“ to „https://“ and by the lock symbol in your browser line. If the SSL encryption is activated, the data that you transmit to us cannot be read by third parties.

 

2.5 Objection to advertising mails

The use of contact data published within the scope of the imprint obligation for the transmission of not expressly requested advertisement and information material is hereby contradicted. The operators of fernweh-koch.de expressly reserve the right to take legal action in the case of unsolicited sending of advertising information, such as through spam e-mails.

 

3. Data collection on this website

3.1 Cookies

The internet pages of fernweh-koch.de partly use so-called cookies. Cookies do not damage your computer and do not contain viruses. Cookies serve to make our offer more user-friendly, effective and safer. Cookies are small text files that are placed on your computer and saved by your browser. Most of the cookies we use are so-called „session cookies“. They are automatically deleted at the end of your visit. Other cookies remain stored on your end device until you delete them. These cookies enable us to recognize your browser during your next visit. You can set your browser so that you are informed about the setting of cookies and allow cookies only in individual cases, exclude the acceptance of cookies for certain cases or in general and activate the automatic deletion of cookies when closing the browser. Most of them will only be played once you have set and accepted your choice regarding the use of certain cookies in the selection menu of the appearing Borlabs field (see 3.6)

 

3.2 Server Log Files

The provider of these pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

These data cannot be assigned to specific persons. A consolidation of this data with other data sources is not carried out. We reserve the right to check this data subsequently if we become aware of concrete indications of illegal use.

 

3.3 Google Analytics

The person responsible for processing has integrated the Google Analytics component (with anonymization function) on this website. Google Analytics is a web analysis service. Web analysis is the collection, collection and evaluation of data on the behavior of visitors to websites. Among other things, a web analysis service collects data about which website a person concerned came to a website from (so-called referrers), which sub-pages of the website were accessed or how often and for how long a subpage was viewed. Google Analytics sets a cookie on the information technology system of the person concerned. What cookies are has already been explained above. By setting the cookie, Google is able to analyze the use of our website. Each time one of the individual pages of this website, which is operated by the person responsible for processing and on which a Google Analytics component has been integrated, is called up, the Internet browser on the information technology system of the person concerned is automatically prompted by the respective Google Analytics component to transmit data to Google for the purpose of online analysis. As part of this technical process, Google obtains knowledge of personal data such as the IP address of the person concerned, which Google uses, among other things, to trace the origin of visitors and clicks and subsequently to enable commission settlements.

 

IP anonymization

The data controller uses the addition „_gat._anonymizeIp“ for web analysis via Google Analytics. By means of this addition, the IP address of the Internet connection of the person concerned is shortened and anonymized by Google if the access to our Internet pages is from a member state of the European Union or from another state that is a party to the Agreement on the European Economic Area. Your IP address is recorded, but immediately (e.g. by deleting the last 8 bits) pseudonymized. Thus only a rough localization is possible.

The collection of IP addresses is done anonymously at fernweh-koch.de, as mentioned above. By means of the cookie, personal information such as the access time, the place from which an access originated and the frequency of visits to our website by the person concerned is stored. Each time our website is visited, this personal data, including the IP address of the Internet connection used by the person concerned, is transmitted to Google in the United States of America. This personal data is stored by Google in the United States of America.

Google may pass on this personal data collected via the technical process to third parties. The person concerned can prevent the setting of cookies by our website, as described above, at any time by means of a corresponding setting in the Internet browser used and thus permanently object to the setting of cookies. Such a setting of the Internet browser used would also prevent Google from setting a cookie on the information technology system of the person concerned.

In addition, a cookie already set by Google Analytics can be deleted at any time via the Internet browser or other software programs. Furthermore, the data subject has the opportunity to object to and prevent the collection of data generated by Google Analytics and relating to the use of this website and the processing of this data by Google. For this purpose, the person concerned must download and install a browser add-on under the link https://tools.google.com/dlpage/gaoptout .

This browser add-on informs Google Analytics via JavaScript that no data and information about visits to websites may be transmitted to Google Analytics. The installation of the browser add-on is considered by Google as a contradiction. If the data subject’s information technology system is deleted, formatted or reinstalled at a later date, the data subject must reinstall the browser add-on in order to deactivate Google Analytics.

If the Browser Add-On is uninstalled or deactivated by the person concerned or another person who is part of their sphere of control, there is the possibility of a new installation or reactivation of the Browser Add-On. Fernweh-koch.de uses Google Analytics only with activated IP anonymization. This means that the IP address of users is shortened by Google within member states of the European Union or in other states that are party to the Agreement on the European Economic Area. Only in exceptional cases is the full IP address transferred to a Google server in the USA and shortened there. The IP address transmitted by the user’s browser is not merged with other Google data.

 

Order data processing

Fernweh-Koch.de has concluded a contract with Google for commissioned data processing and only allows IP addresses to be tracked anonymously in abbreviated form.

 

3.4 Google Maps

Fernweh-koch.de uses Google Maps to display a map of the area. Google Maps is operated by Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. This represents a legitimate interest in the sense of Art. 6 para. 1 lit. f DSGVO and enables the website operators to offer added value to visitors by displaying locations on the corresponding maps. By using this website, you consent to the collection, processing and use of the automatically collected data as well as the data entered by you by Google, one of its representatives or third parties.

 

3.5 Google Fonts

The use of fonts via Google Fonts is in the interest of a uniform and appealing presentation of the online offers of fernweh-koch.de. This represents a legitimate interest in the sense of Art. 6 paragraph 1 lit. f DSGVO. The fonts have been integrated on the server of fernweh-Koch.de and should not normally be accessed via Google’s servers.

 

3.6 Borlabs Cookie

This website uses Borlabs cookie, which sets a technically necessary cookie (borlabs cookie) to store your cookie consent.

Borlabs cookie does not process any personal data.

The borlabs-cookie stores your consent that you gave when you entered the website. If you wish to revoke these consents, simply delete the cookie in your browser. When you re-enter/reload the website, you will be asked again for your cookie consent.

 

3.7 Comment function on fernweh-koch.de

The storage of comments is based on your consent (Art. 6 para. 1 lit. a DSGVO). For the comment function on fernweh-koch.de, in addition to your comment, information about the time of creation of the comment and, if you do not post anonymously, the user name you have chosen are stored. If a person concerned leaves a comment in the blog published on this website, information about the time of the comment and the user name chosen by the person concerned (pseudonym) will be saved and published in addition to the comments left by the person concerned.

The IP address assigned by the Internet service provider (ISP) of the person concerned is not logged or stored by the pages of fernweh-koch.de when commenting.

There will be no transfer of this collected personal data to third parties, unless such a transfer is required by law or serves the legal defense of the person responsible for the processing.

 

3.8 Storage period of the collected data

The criterion for the duration of storage of personal data is the respective legal retention period. After this period has expired, the corresponding data is routinely deleted if it is no longer required for the fulfillment or initiation of a contract.

 

3.9 Routine deletion and blocking of personal data

The data controller processes and stores personal data of the data subject only for the time necessary to achieve the purpose of storage or if this is provided for by the European Directive and Regulation Giver or another legislator in laws or regulations to which the data controller is subject. If the purpose of storage ceases to apply or if a storage period prescribed by the European Directive and Regulation Giver or any other competent legislator expires, the personal data will be blocked or deleted as a matter of routine and in accordance with the law.

3.11 Cookies and traffic reports

Fernweh Koch uses „session cookies“ from VG Wort, Munich, to measure access to texts in order to determine the probability of copying. Session cookies are small units of information that a provider stores in the main memory of the visitor’s computer. A randomly generated unique identification number, a so-called session ID, is stored in a session cookie. In addition, a cookie contains information about its origin and the storage period. Session cookies cannot store other data. These measurements are performed by INFOnline GmbH according to the Scalable Central Measurement Method (SZM). They help to determine the copying probability of individual texts for the remuneration of legal claims of authors and publishers. Fernweh Koch does not collect personal data via cookies.

Some of the pages of Fernweh Koch may contain JavaScript calls which report access to the Verwertungsgesellschaft Wort (VG Wort). This enables the authors to participate in the distributions of VG Wort, which ensure the legal remuneration for the use of copyrighted works according to § 53 UrhG.

3.12 Privacy policy for the use of the Scalable Central Measuring System

Fernweh Koch and the mobile web offer use the „Scalable Central Measurement Method“ (SZM) from INFOnline GmbH (https://www.infonline.de) for the determination of statistical characteristic values to determine the copy probability of texts.

Anonymous measured values are collected in the process. The access count measurement uses alternatively a session cookie or a signature, which is generated from various automatically transmitted information of your browser, for the recognition of computer systems. IP addresses are only processed in anonymized form.

The procedure was developed in compliance with data protection laws. The sole purpose of the procedure is to determine the probability of individual texts being copied. At no time are individual users identified. Their identity always remains protected. You will not receive any advertising via the system.

 

3.13 Newsletter

If you would like to receive the newsletter offered on the website, I need an e-mail address from you as well as information that allows the verification that you are the owner of the e-mail address provided and that you agree to receive the newsletter.

To ensure that the newsletter is sent by mutual agreement, I use the so-called double opt-in procedure. In the course of this procedure the potential recipient can be added to a distribution list. Subsequently, the user receives a confirmation e-mail to confirm the registration in a legally binding manner. Only if the confirmation is received, the address is actively added to the distribution list.

We use this data exclusively for sending the requested information and offers.

Newsletter2Go is used as newsletter software. Your data will be transmitted to Newsletter2Go GmbH. Newsletter2Go is not allowed to sell your data or use it for other purposes than for sending newsletters. Newsletter2Go is a German, certified provider, which was selected according to the requirements of the Data Protection Basic Regulation and the Federal Data Protection Act.

4. Use of social media

In order to protect the data of the visitors of fernweh-koch.de as well as possible, the data protection-safe sharing buttons of „Shariff“ are predominantly used. The Shariff buttons were developed on the initiative of Heise Online and the computer magazine c’t. You can find more information here.

In contrast to other social media plug-ins, the Shariff buttons establish direct contact between the social network and the visitor only when the latter actively clicks on the Share button. The click on the button represents a consent in the sense of Art. 6 para. 1 lit. a DSGVO. This consent can be revoked at any time with effect for the future. When you visit a page that contains such a plugin, your browser establishes a direct connection to the servers of Pinterest. The plugin transmits protocol data to the Pinterest server in the USA. If a data subject wishes to exercise this right of access, he or she may at any time contact our data protection officer or another member of the staff of the controller.

c) Right of rectification

Every person affected by the processing of personal data has the right, granted by the European Directives and Regulations, to request the immediate rectification of incorrect personal data concerning him. Furthermore, the data subject has the right to request the completion of incomplete personal data, also by means of a supplementary declaration, taking into account the purposes of the processing. If a data subject wishes to exercise this right of rectification, he or she may at any time contact our data protection officer or another member of the staff of the data controller.

d) Right of cancellation (right to be forgotten)

Any person affected by the processing of personal data has the right, granted by the European Directives and Regulations, to obtain from the controller the immediate deletion of personal data concerning him/her, if one of the following reasons applies and if the processing is not necessary:

The personal data have been collected or otherwise processed for purposes for which they are no longer necessary.
the data subject withdraws the consent on which the processing was based pursuant to Article 6(1)(a) of the DPA or Article 9(2)(a) of the DPA, and there is no other legal basis for the processing
The data subject lodges an objection to the processing pursuant to Art. 21(1) DPA and there are no overriding legitimate reasons for the processing, or the data subject lodges an objection to the processing pursuant to Art. 21(2) DPA.
The personal data were processed unlawfully.
The deletion of the personal data is necessary to comply with a legal obligation under Union law or the law of the Member States to which the controller is subject.
The personal data was collected in relation to information society services offered in accordance with Art. 8 Paragraph 1 DS-GVO.

If one of the above reasons applies and a data subject wishes to have personal data stored on the website deleted, he or she may contact our data protection officer or another member of staff of the data controller at any time. The data protection officer of the website or another employee will arrange for the deletion request to be complied with immediately. If the personal data have been made public by the website and our company, as the data controller, is obliged to delete the personal data in accordance with Art. 17 para. 1 of the DS-GVO, the website will take reasonable measures, including technical measures, taking into account the available technology and implementation costs, to inform other data controllers who process the published personal data that the data subject has requested that these other data controllers delete all links to these personal data or copies or replications of these personal data, unless the processing is necessary. The data protection officer of the website or another employee will arrange the necessary steps in individual cases.

e) Right to limit processing

Any person affected by the processing of personal data has the right, granted by the European Directives and Regulations, to request the controller to limit the processing if one of the following conditions is met:

The accuracy of the personal data is contested by the data subject, for a period of time that allows the controller to verify the accuracy of the personal data.
The processing is unlawful, the data subject refuses to have the personal data deleted and instead requests the restriction of the use of the personal data.
The controller no longer needs the personal data for the purposes of the processing, but the data subject needs them in order to assert, exercise or defend legal claims.
The data subject has lodged an objection to the processing in accordance with Art. 21 (1) DS-GVO and it is not yet clear whether the justified reasons of the controller outweigh those of the data subject.

If one of the above-mentioned conditions is met and a data subject wishes to request the restriction of personal data stored on the website, he or she may contact our data protection officer or another employee of the data controller at any time. The data protection officer of the website or another employee will arrange for the restriction of the processing.

f) Right to data transferability

Any person affected by the processing of personal data has the right, granted by the European Directives and Regulations, to receive the personal data concerning him/her, which have been provided by the data subject to a data controller, in a structured, common and machine-readable format. He/she also has the right to have this data communicated to another controller without hindrance by the controller to whom the personal data has been made available, provided that the processing is based on the consent pursuant to Art. 6 paragraph 1 letter a DPA or Art. 9 paragraph 2 letter a DPA or on a contract pursuant to Art. 6 paragraph 1 letter b DPA and that the processing is carried out with the aid of automated procedures, unless the processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller. In addition, when exercising their right to data transfer pursuant to Art. 20 Paragraph 1 DS-GVO, the data subject has the right to obtain that personal data be transferred directly from one controller to another controller, insofar as this is technically feasible and provided that this does not adversely affect the rights and freedoms of other persons. In order to assert the right to data transfer, the person concerned can contact the data protection officer appointed by the website or another employee at any time.

g) Right to object

Every person affected by the processing of personal data has the right, granted by the European Directive and Regulation Giver, to object at any time, for reasons arising from his or her particular situation, to the processing of personal data concerning him or her that is carried out on the basis of Art. 6(1)(e) or (f) of the DPA. This also applies to profiling based on these provisions. In the event of an objection, the website will no longer process the personal data, unless we can demonstrate compelling reasons for processing that are worthy of protection, which outweigh the interests, rights and freedoms of the data subject, or the processing serves to assert, exercise or defend legal claims. If the website processes personal data for the purpose of direct marketing, the data subject shall have the right to object at any time to the processing of personal data for the purpose of such marketing. This also applies to profiling, insofar as it is connected with such direct marketing. If the data subject objects to the website processing for the purposes of direct marketing, the website will no longer process the personal data for those purposes. In addition, the data subject has the right to object, for reasons arising from his or her particular situation, to the processing of personal data concerning him or her which is carried out on the website for the purposes of scientific or historical research or for statistical purposes in accordance with Article 89 (1) of the DPA, unless such processing is necessary for the performance of a task carried out in the public interest. In order to exercise the right of objection, the data subject may contact the data protection officer of the website or another member of staff directly. The data subject is also free to exercise his or her right of objection in connection with the use of information society services, notwithstanding Directive 2002/58/EC, by means of automated procedures involving technical specifications.

h) Automated decisions in individual cases including profiling

Every person concerned by the processing of personal data has the right, granted by the European Directives and Regulations, not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning him or her or significantly affects him or her in a similar way, provided that the decision (1) is not necessary for the conclusion or performance of a contract between the data subject and the controller, or (2) is authorised by Union or national legislation to which the controller is subject and such legislation provides for adequate safeguards of the rights and freedoms and legitimate interests of the data subject, or (3) is taken with the explicit consent of the data subject. Where the decision is (1) necessary for the conclusion or performance of a contract between the data subject and the controller or (2) is taken with the express consent of the data subject, the website shall take reasonable measures to safeguard the rights and freedoms and legitimate interests of the data subject, which shall include at least the right to obtain the intervention of a person from the controller, to put forward his point of view and to challenge the decision. If the data subject wishes to exercise rights relating to automated decisions, he or she may at any time contact our Data Protection Officer or any other employee of the controller.

i) Right to revoke a data protection consent

Every person affected by the processing of personal data has the right granted by the European Directive and Regulation Giver to revoke his or her consent to the processing of personal data at any time. If the data subject wishes to exercise his or her right to revoke consent, he or she may at any time contact our data protection officer or any other employee of the data controller.
